Terms of Service

1. The game is in development

Hextalon is in alpha. Things will change, break and be rebalanced, sometimes without notice. That includes the value of items and currencies, the rates at which things drop, and how systems work. We may reset characters, items, currencies or the whole world during testing. The game may be unavailable at times, and we may end it altogether.

2. Who can play

• You must be at least 13 years old.
• If you are under 18, you need the permission of a parent or guardian, who should read these terms with you.
• You may have one account. See the Rules on accounts shared by a household.
• You may not play if we have banned you, including by creating a new account.

3. Your account

Keep your password secret and your sign-in method secure. Your account is personal to you: do not share, lend, sell or transfer it, and do not use anyone else's. You are responsible for everything done on your account. Tell us straight away if you think someone else has accessed it. Character and account names must follow the Rules, and we may change a name that does not.

4. Playing fairly

The Rules are part of these terms. In particular you must not:

• use bots, scripts, macros or any tool that plays or sends requests for you;
• exploit bugs, or keep using one after you know about it, instead of reporting it;
• interfere with the game, its servers or other players' access to it, or try to get into anything you are not meant to;
• scam, harass or threaten other players;
• buy, sell or trade accounts, items or currencies for real money or anything outside the game.

5. Items and currencies

Gold, Cinders, Artifacts, items and everything else you earn or receive in the game are part of the game. They are not money, have no value outside Hextalon, and cannot be cashed out. We grant you a personal, revocable licence to use them while you play; you do not own them. We may change, remove or rebalance them, and may remove any gained by breaking these terms.

6. Purchases

Hextalon may offer optional purchases in future. If it does, the price and what you receive will be shown before you pay, and these terms will be updated to cover them.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights, or any other right you have under consumer laws that apply to you.

7. What you post

You keep ownership of what you write in Hextalon: chat messages, whispers, your bio, names you put forward, and feedback. You give us a free, worldwide licence to store, display and use it to run the game. Feature ideas you send us may be used freely, without payment or credit. We may remove or edit anything that breaks the Rules. Do not post anything you do not have the right to share, or other people's personal information.

8. Moderation and enforcement

If we reasonably believe you have broken these terms or the Rules, we may warn you, mute you, remove items or currencies, reset progress, or suspend or ban your account. We decide based on the evidence available to us and how serious the breach is. Decisions are made by people, not automatically. 9. Our game

Hextalon's code, art, text, world and design belong to us or our licensors. You may play the game and share screenshots and talk about it. You may not copy, resell, reverse engineer or build a competing service from it.

10. Liability

Hextalon is a free game in development, provided as it is and as available. To the extent the law allows, we are not liable for lost progress, items or currencies, interruptions, or any indirect or consequential loss. Where the law does not allow liability to be excluded but allows it to be limited, our liability is limited to supplying the service again or paying the cost of doing so. Nothing in this section excludes rights you have under the Australian Consumer Law.

11. Ending your account

You can stop playing at any time, and ask us to delete your account by emailing hextalonidle@gmail.com. We may suspend or close an account that breaks these terms, or close all accounts if the game ends.

12. Changes to these terms

We may update these terms as the game changes. The date at the top shows when they last changed, and we will announce significant changes in the game. If you keep playing after a change, you agree to the updated terms.

13. Law

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction. If you live somewhere whose consumer laws give you rights that cannot be excluded, you keep those rights.
